Terms of Use

Welcome to Tucked Away (the “Service”). These Terms of Use (the “Terms”) are a legally binding agreement between you and Marc Thun, Hinüber 6, 42477 Radevormwald, Germany (“we”, “us”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are participating as a tester, these Terms apply in addition to any separate tester or NDA agreement you may sign with us.

1. Who may use the Service

  • You must be at least 16 years old (GDPR minimum) or the age of digital consent in your country, whichever is higher.
  • If you are under 18, you confirm you have the permission of a parent or legal guardian to use the Service.
  • You may use the Service only for personal, non-commercial purposes unless we agree otherwise in writing.

2. Beta/Invite-Only Notice

The Service may be offered as a beta or invite-only product. Features may change, break, or be withdrawn at any time. We may suspend or terminate access (including tester accounts) at our discretion.

3. Not medical advice

Tucked Away provides self-help and wellbeing tools. We do not provide medical, psychological, or psychiatric advice. The Service is not a substitute for professional diagnosis, treatment, therapy, emergency assistance, or crisis help. If you are in crisis or think you may harm yourself or others, call your local emergency number or a crisis hotline immediately.

4. Your account

  • You are responsible for maintaining the confidentiality of your login details and for all activities under your account.
  • You must provide accurate information and promptly update it as needed.
  • We may refuse, suspend, or revoke access if we believe these Terms are violated.

5. Acceptable use

  • Do not use the Service in ways that are unlawful, harmful, abusive, harassing, defamatory, or hateful.
  • Do not attempt to access accounts or data without permission or interfere with the Service’s operation.
  • Do not upload content that infringes third-party rights (e.g., copyright, privacy).
  • Do not use the Service to train models or collect data about other users without our written consent.

6. Your content

You retain ownership of the content you write or upload to the Service (“Your Content”). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and backup Your Content as necessary to provide and improve the Service, fix bugs, and ensure security. You are responsible for Your Content and must have all rights needed to grant this license.

7. Feedback

If you send suggestions, ideas, or feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free license to use them without any obligation to you. Please do not share confidential information in feedback unless we have a separate NDA in place.

8. Privacy

Our processing of personal data is described in our Privacy Policy. We host the Service on Vercel (including Vercel Analytics) and we use Mailchimp to manage email/newsletter subscriptions. These providers may process data outside the EU; we rely on appropriate safeguards (e.g. SCCs) where required. For privacy requests, please contact privacy@tuckedaway.app.

9. Third-party services

The Service may integrate third-party providers, including but not limited to:

  • Vercel (hosting, CDN, logs, and privacy-friendly analytics to understand usage);
  • Mailchimp (newsletter and email list management, storing your email address if you sign up);
  • OpenAI or similar AI providers (to process prompts and generate responses where the feature is used);
  • MongoDB Atlas or similar database services (to store user-related data);

We are not responsible for third-party websites, apps, or services; your use of them is subject to their terms and privacy policies.

10. Intellectual property

The Service, including its software, design, text, graphics, and trademarks, is protected by intellectual property laws and remains our property or that of our licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission. All rights not expressly granted are reserved.

11. Service changes

We may change or discontinue features at any time. We will try to provide reasonable notice for material changes when feasible. Continued use after changes means you accept the updated Terms.

12. Warranties and disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, even if we have been advised of the possibility. Our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the liability, or (b) EUR 100.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so (e.g., liability for death or personal injury caused by negligence; fraud; or breaches of mandatory consumer protection law).

14. Indemnity

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising from your use of the Service or your violation of these Terms.

15. Suspension and termination

We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (e.g., IP, Feedback, Disclaimers, Liability limits).

16. Governing law; venue; consumer rights

These Terms are governed by the laws of Germany, without regard to its conflicts of laws rules. If you are a consumer residing in the EU/EEA/UK, you may also enjoy the protection of mandatory provisions of your local consumer law and may bring proceedings in your local courts. Otherwise, exclusive jurisdiction and venue will be the courts of Cologne, Germany (or another city you prefer in NRW).

17. Export controls and sanctions

You may not use the Service in or for the benefit of persons or entities in embargoed or sanctioned countries, or otherwise in violation of applicable export control and sanctions laws.

18. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and change the “Last updated” date above. For material changes, we will take appropriate steps to notify you.
